General terms and conditions

1. Scope
These terms apply to the provision of DealerHub software by Fusion-Media to business customers in Switzerland. Deviating customer terms apply only if confirmed in writing.
2. Service
DealerHub is provided as browser-based software according to the subscribed plan. The productive tenant platform runs at app.dealerhub.ch. The public website and interactive demo at dealerhub.ch are for information and trial use and are not a production system. Modules may be limited by plan. Maintenance windows and further development remain reserved.
3. Customer duties
The customer is responsible for access data, the lawfulness of entered data and internal rights. The demo environment must not be used for live data. Personal data of customers, staff and partners that the customer records in its company space remains the customer’s data-protection responsibility.
4. Prices and term
The monthly prices in CHF on the pricing page apply, plus any statutory charges. Individual work is offered separately. Termination follows the respective agreement.
5. Data protection and confidentiality
Fusion-Media processes personal data under the privacy notice and the Swiss Data Protection Act. Operational and customer data from the production system are treated as confidential and are not used for third-party advertising.
6. Liability
Liability is governed by Swiss law. To the extent permitted by law, liability for slight negligence, indirect damage and lost profit is excluded. Liability for personal injury and for gross negligence and intent remains unaffected.
7. Governing law
Swiss law applies, excluding conflict-of-law rules and the UN CISG. The place of jurisdiction is, to the extent permitted, the seat of Fusion-Media in Nänikon ZH.
